Objections and Appeals
If you disagree with a decision by a university body, such as the Executive Board, the Dean of a Faculty, the Examination Board or an examiner, there are legal options available to you. You can submit an objection or lodge an appeal against this decision.
It should concern a written decision that directly affects your interest.
Of course, you do not necessarily have to start an appeal or objection procedure if you have a difference of opinion with someone. Talking to the person who took the decision is often enough to resolve the issue. You can ask a student counsellor or student advisor to help you with this or to give you advice. He or she can also mediate on your behalf if you do not wish to talk directly to the person who made the decision. During the informal talk, bear in mind the time limits for submitting an objection or appeal. The possibility to submit an official notice of objection or appeal expires after six weeks after the day following the date on which the decision was sent. It is advisable to submit a notice of appeal in good time so that you stay within the time limits, even if you are still discussing the issue with the persons involved. In your notice of objection or appeal you can indicate that you will send further reasons later. If the discussions lead to a positive result you can withdraw the objection or appeal.
There are different procedures depending on the type of decision involved.
Advisory Committee on Objections
You can submit a notice of objection against decisions by or on behalf of the Executive Board. This mainly concerns decisions on enrolment as a student, decentralised selection, termination of enrolment, payment or refund of tuition fees, financial aid and having been barred entry to the university’s buildings, premises or facilities. Your notice of objection will first be handled by the Advisory Committee on Objections. This Committee advises the Executive Board about your objection, after which the Executive Board reconsiders the case and makes a decision regarding your objection. If you disagree with the decision regarding your objection, you can submit an appeal with the Higher Education Appeals Tribunal in The Hague within six weeks of the decision. You can also consult Chapter 10 of the Students' Charter 2012-2013, which provides specific information about your legal protection as a EUR student.
Examinations Appeals Board
The law specifies what decisions on education, (admission to) examinations and interim examinations you can appeal against with the Examinations Appeals Board (CBE). If you disagree with written decisions by examination boards and examiners you can appeal against these decisions with the Examinations Appeals Board within six weeks. Information on the appeal procedure with the CBE can be found in the Student Information Leaflet "Submitting an appeal with the Examinations Appeals Board" or in Chapter 10 of the Students' Charter 2012-2013. You can also visit the website of the CBE, where you can find the CBE's rulings on various disputes. If you disagree with the decision regarding your objection, you can submit an appeal with the Higher Education Appeals Tribunal in The Hague within six weeks of the decision.
Submitting a notice of appeal or objection
In all cases you can submit your notice of appeal or objection to one central service point, the EUR Legal Protection Facility, either by post or online. After submitting your objection or appeal you will receive confirmation of receipt and your notice of objection or appeal will be forwarded, often on the same day, to the competent body for further treatment. This body will notify you of the course of the procedure.
Period of objection or appeal
In all cases the period of objection or appeal is six weeks.
EUR Legal Protection Facility
With effect from the 2010-2011 academic year the EUR has one central service point to which all complaints and notices of appeal and objection can be submitted online, the EUR Legal Protection Facility.
o Keep a close eye on all time limits
o Always specify your name, address, telephone number, student number, e mail address and your study programme
o State briefly and concisely all relevant, factual information
o Clearly indicate the grounds on which you base your complaint, objection or appeal
o Do not forget to enclose a copy of the decision against which you are submitting an objection or appeal
o If you have any questions or in case of doubt, contact a student counsellor, student advisor, the secretary of the Examinations Appeals Board or the secretary of the Advisory Committee on Objections in good time.
