Medical scientific research with humans is research related to illness and health. It is designed to find specific information about a disease or its treatment by systematically collecting and studying data. It aims to contribute to medical knowledge. In the interest of the data subject, they should only be subject to adequate and solid research. This research is conducted in a safe manner, with regard to the fundamental rights of individuals. In order to improve existing treatment for critical medical and surgical conditions, and to test newly developed medication or treatments, emergency research is conducted on critical ill patients. Unambiguous and sufficient regulation and procedures that apply to medical scientific research aim to guarantee the fundamental rights of the data subject. However, it is not always clearly formulated, or leaves room for interpretation. In addition, the regulation is not always known to doctors, nurses, researchers and institutional review boards (IRBs), who conduct or judge medical research. These ambiguities may create uncertainty and frustration among medical researchers and may lead to legal uncertainty. In addition, valuable research initiatives may not be implemented, due to unjustified rejection. The overall aim of this thesis is to expand knowledge of the regulation of emergency research, both from the legal perspective and the medical perspective.
